Gulfstream Park Racing Association Inc. defeated a False Claims Act suit alleging that the Florida horse-racing venue committed fraud by concealing improper wastewater practices from the Environmental Protection Agency, a federal district court said.

Whistleblower Michael Fucheck didn’t adequately raise a reverse false claim, which requires showing that a defendant knowingly concealed or improperly avoided an obligation to pay the government, Judge Raag Singhal of the US District Court for the Southern District of Florida said in a Wednesday order.
